Portal Access and Data Privacy Notice

1. Identification of Data Controllers

The Armed Forces of the Philippines (AFP), as primary Data Controller, and ZMG Ward Howell, as its authorized Data Processor under a formal service contract, jointly administer this portal. Both entities are registered personal information controllers with the National Privacy Commission (NPC) and are subject to RA 10173 (Data Privacy Act of 2012), its Implementing Rules and Regulations (IRR), and all applicable NPC issuances.

2. Legal Basis for Processing

Your personal data is processed based on the following legal bases:

  • Your freely given, specific, informed, and unambiguous consent (Sec. 12[a] and Sec. 13[b], RA 10173).
  • Compliance with the duty of a public authority legally vested in AFP (Sec. 12[e], RA 10173).
  • Performance of a contract or pre-contractual steps in relation to AFP human resource management (Sec. 12[b], RA 10173).

3. Personal Information We Collect

By proceeding, you acknowledge that this portal will collect and process the following categories of personal data:

  • Identity information — full name, AFP Service Number, date of birth, nationality
  • Contact details — residential and mailing address, telephone number, personal email address
  • Employment records — rank, branch, unit assignment, length of service, positions held
  • Educational background — academic degrees, training programs, certifications, learning and development records
  • Professional skills, competencies, and career achievements
  • Sensitive Personal Information (Sec. 3[l], RA 10173) — including health information, government-issued identifiers, biometric data (photographs), and other sensitive data appearing in your uploaded CV

4. Purposes of Data Collection and Processing

Your personal data will be used exclusively for the following specified, explicit, and legitimate purposes:

  • Talent assessment and competency matching for AFP human resource planning and development
  • Building and maintaining a verified talent pool of current and retired AFP personnel
  • Preparation of assessments, reports, and assignment recommendations for AFP
  • Internal coordination within the authorized AFP project team of ZMG Ward Howell

5. Core Data Privacy Principles (Sec. 11, RA 10173)

6. Data Retention and Disposal

Your personal data will be retained only for as long as necessary to fulfill the stated purposes, and in no case beyond the termination or expiry of the service contract between AFP and ZMG Ward Howell. After termination, all data must be securely deleted, destroyed, or returned to AFP within thirty (30) calendar days, in accordance with NPC Circular No. 16-01.

7. Your Rights as a Data Subject (Sec. 16–18, RA 10173)

Under the Data Privacy Act of 2012, you have the right to:

  • Right to Be Informed: To know how your personal data is or will be processed (Sec. 16[a]).
  • Right to Access: To obtain a copy of your personal data held by AFP and ZMG Ward Howell (Sec. 16[c]).
  • Right to Rectification: To correct inaccurate, incomplete, or outdated personal data (Sec. 16[c]).
  • Right to Erasure or Blocking: To suspend or withdraw data where processing violates the DPA (Sec. 16[d]).
  • Right to Data Portability: To receive your data in a structured, commonly used, and machine-readable format where technically feasible (Sec. 18).
  • Right to Object: To withhold consent or object to processing under certain circumstances (Sec. 16[f]).
  • Right to Withdraw Consent: At any time, without prejudice to the lawfulness of prior processing (Sec. 16[e]).
  • Right to Damages: To seek indemnification for harm caused by inaccurate, incomplete, outdated, or unlawfully obtained data (Sec. 16[g]).
  • Right to File a Complaint: To submit a complaint to the National Privacy Commission (www.privacy.gov.ph) if you believe your rights have been violated.

8. Cross-Border Data Transfers

Your personal data will not be transferred to any foreign entity or stored on servers outside the Philippines without prior notification to the NPC and your explicit written consent, except where required by law or a legal order.

9. Changes to This Notice

AFP reserves the right to update this Privacy Notice in accordance with changes to applicable laws or AFP policies. Material changes will be communicated through the portal before taking effect. Continued use of the portal constitutes acceptance of the updated Notice.

I have read and fully understood the Data Privacy Notice above, including the legal bases, purposes, and scope of processing.

I acknowledge that AFP and ZMG Ward Howell are jointly responsible for the lawful processing of my personal data for the purposes stated herein.

I confirm that I am voluntarily and freely submitting my information without compulsion or undue influence, and that I understand my rights as a data subject under RA 10173.

I understand that I may withdraw this consent at any time by contacting the AFP Data Protection Officer.

I have been informed of the identity of both the Data Controller (AFP) and Data Processor (ZMG Ward Howell), and I agree to the processing of my personal data.

I acknowledge that I may file a complaint with the National Privacy Commission (www.privacy.gov.ph) if I believe my rights have been violated.
